Either agreement could be made, but before you sublease, make sure that the owner of the property allows subleases. Most landlords do not allow it. You may end up with no place to live after being asked to leave by the landlord if you do not have his signed agreement. Some original leases say right in the verbiage whether a sublease is acceptable so ask to see the former tenants lease with an original signature or enter into an agreement with the owner.
