Hi. l recently lost my job and cannot afford to pay my rent this month. l have only lived in my complex for two months. l am pretty sure l will be evicted. If l am evicted will l for sure have to go to court or can l just tell my landlord l will be out by the time he needs me to be. l cannot afford court fees. If l could then l would not have to worry about being evicted. l live in the Tampa Bay area in FL. Someone please answer my question seriously! l do not need negative remarks!

l live in ur state, ok? Truthfully, the office will put an eviction notice on ur door. If you're not out by that date, then they have to call the Sheriff is office, who will put a note on ur door. You then have 24-72 hours to get out,(whatever their sticker says.). Your complex probably will attempt to sue u in civil court for the rent u owe/eviction process/broken lease, but I've not really heard of anyone going. l do not think they need u there. They can just get a judgement against ou & garnish ur wages in the future.

Hi, no for them to evict you, u do not have to go to court. They will give u 30 days usually & then the police will come get u out if u do not leave voluntarily. ALTERNATIVELY, u can leave before u r ''evicted'' on ur own. Tell them u cannot afford to stay in ur lease or in the apartment & u need to do a Sublease or Sublet the apartment (same thing). They will probably require u to find someone else to take over the lease on ur own. You can list subleases at craigslist.com (click on Florida, then Tampa Bay area, then apartment/housing rentals & then post the ad). It is free.

The only way u might possibly end up in court is if u leave & they do not rent the apartment back right away & u owe a few months rent (until someone takes over ur apartment). Then if u do not pay that fee, they can take u to small claims court. But, u will be able to tell the judge then that u lost ur job & had no choice. Bring all necessary documents (pink slip etc.) with u at that time if the time comes. You do not have to have an attorney present. You can represent yourself. l did this with a creditor once. It is not scary at all & usually u do not go to a court room, u actually meet in the judge is chambers (like his office).

l hope this helps!! Just be up front & honest right now with ur landlord. They may cut u a break of some sort since the economy is bad. If not, then go ahead & leave. Do not make them have to evict you. Leave voluntarily first.
