We are renters who just had an annual inspection of our home. The landlord says that there is a gopher problem and we need to take care of it. Is not that the landlord is responsibility? Also, it was that way when we moved in. Anybody know, legally, if it is our responsibility or the landlord is to get rid of the gophers?

Depends on what is written in the lease. In most cases, the exterior (minus mowing and flowers) is the landlord is responsibility.


You just need to READ your lease! Also, if it says you need to take care of it, you need to kindly remind your landlord that it was a pre-existing condition.

You need to read the lease. That should say whose responsibility it is.

Gophers are yard maintainance. Whoever maintains the yards get to take care of gophers.

Generally it is the tenant in a house or duplex, landlord in an apartment complex.

Neither you nor your landlord will ever be able to get rid of the gophers. Anyone who has ever had a gopher problem will tell you the same. Buy a trap and keep it in a gopher hole so you can prove you're ''taking care of the problem''. All you can really do is keep covering the holes to prevent a trip hazard, which would be my recommendation for your personal safety. That should appease your unreasonable and unrealistic landlord.
