l purchased a house 13 YRS ago, this house had been moved previous to me buying it.l recived a loan for this house.l am now selling the house and had a contract on it and was supposed to close today.Last week the couple that was supposed to buy the house backed out and said their mortgage lender told them that FHA nor Conventional would not loan on a house that has been moved.We had a disclosure statement saying it had been moved that the lender saw 3 weeks ago.The lender sent a letter to the real estate agent stating what l wrote above.What can be done legally to rectify this if anything?

FHA will not lend on the property. There is one program, the 203K, program that provides FHA financing for the property & funds to repair the property to an adequate manner. The catch, covers pretty much everything except structural items, namely ur foundation. There r many conventional programs & they can be different from bank to bank, ie. local, national, credit union.

As an appraiser, l have encountered this situation a few times. l think the best first step from here would be to contact a structural engineer & see what they recommend. There would more than likely be some retrofitting required, but regardless of the remedy u will need an engineers certification.

This could indicate future issues with the structural integrity of ur home, a serious question in regards to its future value as collateral to a mortgage.
