My old landlord is trying to charge me $121 on top of the $250 deposit l paid them. My question, is in regards to my written dispute with them for not paying this billed amount.

They supposidly had to rehang blinds (buy new ones) as well as secure our balcony door (in which was not secure when we moved in), apparently fix a bracket in the closet (which l used everyday and know was perfectly fine), as well as touch up some holes (even though we spent several days looking at them to make sure they were all filled, and replacing the smoke alarm battery. Thus they are making us pay the additional $121 to cover the remainder of those charges.

Woud not the smoke alarm battery would be their responsibility to change as it is regular maintenance? And touching up the walls should be part of their typical paint job in between each tenant (even though they had not been repainted before we moved in), as well as hanging closet doors (which l really do not think needed rehung) and replacing blinds should have been their normal maintenance as well??

How do l fight this? l want my money back, and I am not paying this $121 fee...

If you do not agree with the charges, you only recourse to to sue them in small claims court.

it depends on what you signed some leases state they charge you to repaint when you you move period.

As reenzz said, u can take them to court.

Painting is NOT ''normal maintainance'' & certainly not typically done between tenants.

The only thing u have right here is the battery, which it is not really our job to maintain it, we have to make sure it works when u first move in, & putting in a new battery would e part of that.

If u messed up the blinds u need to replace them, that is where most of this would come from. They need to be in the exact same condition when u leave as when u came. If the closet door was not opening properly it sounds like replacing the bracket is what it took. But, that is only a few bucks, the real issue is the blinds & maybe the paint.

Unfortunately, green, l think that Landlord is stating/summing it up pretty much. The majority of ur 'leg to stand on' is the lease agreement u signed when u moved in. In Texas, u sign an agreement that usually includes a form sheet that u fill out with the condition of the apartment / house, & turn back into them (usually within 24 to 48 hours). This gives the landlord the opportunity to fix anything they missed or didnt have in operating order. Then, when u move out, u take (your copy) the lease agreement & go over any changes in condition of the apartment. the last place my mother moved out of, we asked them for a checklist of things to look for (when they r going over what to deduct out of ur deposit). We got $206 of $300 back. Texas is pretty rough on tenants, so ur state may vary. but this is kinda typical. If we had a situation come up like yours, we would take them to small claims court, with all of our documentation (lease agreement, form sheet with condition of apartment on move in, etc), pictures & video of the apartment when we moved in & then moved out, the form that included what they checked at move out, the breakdown on the deposit refund (or charges) etc. Then its up to the judge. Without a copy of ur lease, & something that everyone signing the lease agreed to as far as condtion of the apartment (and a video really really helps - picture is worth a thousand words), u r up a creek without a paddle. Half the time, the apartment sends u a bill to make u go away, when u send them a courtesy copy of what u r taking to court for the judge to see, tunes change.. but u had to have done ur homework first.
