We got something called a Vesting Form from our escrow company to fill out.It asks how my wife and l are taking title and it gives us 4 options:
1. As community Property w/ right of Survivorship.
2. As Community Property
3. As joint tennants
4.As tenants in common.

Both my realtor and the escrow officer said they cannot make suggestions on this and to contact a CPA or attorney if we need to.Can anyone help us choose.What is the right one and what do they really mean?We want it so we have equal rights, and if l die she gets it and vice versa.We do not have a will completed yet if that matters.

Call an attorney in ur area who specializes in real estate law. Pay the consultation fee necessary to have him or her explain these four options & why one might be better than another as well as the drawbacks from one to another.

Purchasing a home is one of the most important things u will do in ur life. And how u take title is an important issue. There r variables like ''do one of u have children from a previous marriage?'' If so, & one of u dies, & the child(ren) has not been adopted by the other spouse, do u want ur share of the house to go to that child or to ur husband?

Talk to the attorney. You cannot get the correct guidance here because there r too many variables that can affect ur decision.

Instead of asking for such specific legal advice in this forum, you should listen to your REALTOR and the escrow officer. The cost will be minimal especially in relation to the importance that this decision could have to you and your family.

Actually, the attorney is probably the best one to take this question to and you can discuss the will you do not have as well.

In Florida, it would be Joint Tenancy with Right of Suviorship. Equal rights - one can not sell without the others approval. If one dies, the other is sole owner.

No one can really advise you how to do this. l would suggest a real estate attorney. Or you can have your parents create a living trust and transfer the house to the trust.

Either way you go, you need to ensure all interest is are covered. Each vesting has it is own ramifications, and without knowing your personal situation, no one can advise.
