mo. after move out. he is charging ''market rent'' for the months that we left early, but someone else is living there. How can we find out how long they have been there so the landlord can not charge us both. Since 30 days has passed are we still liable?

If you signed a lease and agreed to pay rent for the entire term of the lease, then he may well be within his legal rights to expect you to pay it. Whether it is been 30 days or not does not matter. What matters is what is in writing in the lease.

Check the landlord/tenant laws in your state to see what they say about how much the landlord is entitled to when a tenant walks out on a lease early.

You wont have to pay unless you had a lease one the place, if so then you would have to give the land lord 30 days!!! but he cant collect rent on 2 differ tenants

If the landlord litigated the matter & received judgment against you, he can collect those damages, which r no longer considered rent.

If he did not litigate, u r still liable for those months of the contract u failed to live up to. He can litigate over the matter for those months & most likely the court will find on his behalf.

If however he has rented the property then he has mitigated his damages. You r responsible only for the time the property remained empty, or if he rented it for less than ur agreement, u r responsible for the difference between the contracts for the period of ur original contract plus any amount spent to repair & advertise the premises.

Because u failed to abide by ur contract, it is possible for him to seek punitive damages depending on the state. Punitive damages r a way for the courts to punish u for failing to uphold the contract.

If he litigates in Small Claims, he cannot seek punitive damages.
